Probate & estate sales in Texas

Selling a loved one’s home in Texas

In Texas, you usually need legal authority before you can sell a loved one’s home — most often Letters Testamentary from the probate court. Once that’s in hand, an independent executor can list, accept an offer, and close much like any other sale. I work in step with your probate attorney so the real estate never gets ahead of the court.

Letters Testamentary

The court’s “permission slip.” In most Texas cases the executor or administrator must hold Letters Testamentary (or Letters of Administration) before signing a listing agreement or deed. In major Texas metros these often take a few weeks to obtain.

Independent vs. dependent administration

If the will grants a “power of sale,” an independent executor can usually sell without a judge approving each step. Without that language, a dependent administration may require court sign-off on offers  which adds time.

Muniment of title

A faster Texas-only option when there’s a valid, uncontested will and no real estate debts beyond a mortgage. It transfers title to the heirs without a full administration  often in about four to six weeks.

Affidavit of heirship

When there is no will, Texas law decides the heirs. An affidavit of heirship or a small-estate process can sometimes establish ownership without full probate. Your attorney will tell you which path fits.

Taxes are often gentler than expected

Texas has no state inheritance or estate tax. And because of the federal “stepped-up basis,” capital gains on an inherited home are frequently small. Always confirm your numbers with a CPA.

No. Many of my sellers choose to sell “as-is,” especially when downsizing or settling an estate. Before you spend a dollar, I’ll show you an honest comparison of what light preparation might add versus selling as-is, so you can keep more of your equity and skip work that won’t pay off.
How do I sell my parents’ house after they pass away in Texas?
Start with an attorney, then an agent. In most Texas cases you first need legal authority to sell — usually Letters Testamentary from the probate court — before listing. Once that’s in place, I handle the sale in step with your attorney: pricing, clean-out, marketing, and closing, while keeping every heir informed.
What is a Seniors Real Estate Specialist® (SRES®)?
An SRES® is a REALTOR® who has completed National Association of REALTORS® training focused on clients age 50 and older. It signals a patient, consultation-first approach and knowledge of the financial, housing, and emotional questions that come with downsizing, relocating, or selling a long-held family home.
How long does probate take before I can sell in Texas?
It varies by county and estate. Obtaining Letters Testamentary often takes a few weeks in major Texas metros, and independent administrations generally move faster than dependent ones. Muniment of title can take roughly four to six weeks. Your probate attorney sets the true timeline; I line up the sale to match it.
Will I owe taxes when I sell an inherited home in Texas?
Texas has no state inheritance or estate tax. Thanks to the federal “stepped-up basis,” capital gains on an inherited home are often modest because the home’s value resets to its worth on the date of death. Everyone’s situation differs, so please confirm the specifics with your CPA.
Can you help with clearing out and downsizing the house?
Yes , this is often the most overwhelming part, and you won’t face it alone. I coordinate trusted senior move managers, organizers, estate-sale professionals, and cleanout crews, bringing in the right help at the right time so the home is ready without exhausting you or your family.
What if we’re not ready to sell yet?
That’s completely fine. Many families meet with me months or years ahead just to build a plan. I’ll help you understand your options and timing with zero pressure and no obligation. When you’re ready, you’ll already have a trusted advisor who knows your situation.
Do you charge for a consultation?
No. Your first consultation is free and comes with no obligation. It’s simply a conversation about your goals, your home, and your options, whether you decide to move next month, next year, or not at all.
